Thisa'smeasuresonimportsofautomobileparts。TheEuropeanuheUesandadahaveidehefollowingasthemeasuresatissueinthiscase:

（a）PoliDevelopmentofAutomotiveIndustry（OrderoftheNatioandReformission（No。8））（“PolicyOrder8”），whiteredintoforay2004;

（b）AdministrativeRulesonImportationofAutomobilePartsCharacterizedaspleteVehicles（DecreeofthePeople'sRepublia，No。125）（“Decree125”），whiteredintofor1April2005;and

（VerifiportedAutomobilePartsCharacterizedaspleteVehicles（PublieomsGeneralAdministrationofthePeople'sRepublia，No。4of2005）（“A4”），whiteredintofor1April2005。

TheEuropeanuhePaofindthatahasasistentlywith:

（a）ArtidArticle2。2reementinh1（a）oftheIllustrativeListaheTRIMsAgreementbyapplyimeasuresrelatedtoodsthatareiheprovisionsofArticleⅢorArticleⅪofGATT1994andbyapplyimeasuresrelatedtoods，pliahwhiecessarytoobtainanadvantage，andwhichrequirethepurchaseorusebyaerpriseofproduestiaicsource，whetherspetermsofparticularprodutermsofvolumeorvalueofprodusofaproportionofvolumeorvalueofitslocalprodu。Further，ahasasistentlywithArtid2。2reementinh2（a）oftheIllustrativeListaheTRIMsAgreement，byapplyimeasuresrelatedtoodsthatareiheprovisionsofArticleⅢorArticleⅪofGATT1994andbyapplyimeasuresrelatedtoods，pliahwhiecessarytoobtainanadvantage，andwhichrestrictstheimportatioerpriseofproductsusedioitslocalproduerallyortoanamouhevolumeorvalueoflocalproduthatitexports;

（b）itsobligatioheMarrakeshAgreemeablishiradeanizatioiotheAofthePeople'sRepubliatotheWTO，inparticularPartIparagraph7。3oftheProtocolofAofdinparagraph203PartyReportontheAofaragraph1。2oftheProtocolofAofdparagraph342PartyReportontheAofabyfailing，upooplyfullywiththeTRIMsAgreement，withoutrecoursetoArticle5thereof，aelotrequirementsandtohetermsoftratainis;

（c）ArticleⅢ:4oftheGATT1994byimposihresholdsforimportedpartsinanassembledvehicleabovewhiadditieappliesoneachimportedpartihevehiaddition，aspartofthemeasures，posesadditionaladministrativerequirementsonimportersandmamayherequiredthresholdfordomestit。Thereby，ahasfailedtoaccord，toproductsoftheterritoryoftheEuropeanuedioryofa，treatmentnolessfavourablethanthataccordedtolikeproduatiiofalllaws，regulatiosaffegtheirinternalsale，forsale，purchase，transportation，distributionoruse;

（d）ArticleⅢ:2oftheGATT1994bysubjegtheproductsoftheterritoryofotherMembersimportedioryofa，diredirectly，toiaxesorotherinternalchargesofanykihoseapplied，diredireesticproduahasalsoappliediaxesorotherinteroimportedordomesticproduamararytotheprihinparagraph1ofArticleⅢ;
